- Purpose
This SMS Opt-In Policy describes the terms under which you may subscribe to receive text message communications from Pearce Farms and how you may opt out of receiving them. This policy is part of our commitment to comply with applicable laws and regulations (including the Telephone Consumer Protection Act (TCPA) and industry standards).
- How to Opt-In
You may opt-in to receive text messages from us in one or more of the following ways:
- By entering your mobile phone number in a sign-up form on our website and checking a box (not pre-checked) confirming you agree to receive recurring text messages from Pearce Farms.
- By texting a specified keyword (e.g., “FARMS” or “PEARCE”) to a designated short code or number, when we have provided that keyword/number.
Whatever the method:
- You will be informed that your participation is voluntary and you provide your mobile number for the purpose of receiving SMS/text communications.
- You will be informed of the approximate frequency of messages (e.g., “You’ll receive up to X messages per month”).
- You will be informed that message & data rates may apply.

- You will receive a confirmation text message acknowledging your opt-in and giving you the option to reply “YES” (or similar) to confirm if we are using a double opt-in approach.
- What Types of Messages You May Receive
Depending on your opt-in selection, you may receive:
- Transactional messages: order confirmations, shipping updates, account alerts.
- Promotional messages: exclusive offers, farm-news, updates on fresh produce or special events, invitations, and relevant marketing.
- Other informational messages: including but not limited to product launches, club or membership updates, farm events, etc.
- Message Frequency and Costs
We may send messages periodically. Message frequency will vary depending on the nature of the alert or promotion. Message and data rates may apply from your mobile carrier. By opting in, you understand you may incur such charges.
- Opt-Out / STOP Instructions
You may opt out of receiving promotional (and in many cases, all) text messages from us at any time by replying “STOP” (or other keyword we provide) to any message you receive from us. After you reply “STOP,” we will send you a confirmation message and you will no longer receive promotional messages. If you also want to stop transactional messages, please follow instructions in that confirmation or contact us at [insert contact info]. You may also reply “HELP” or “INFO” to receive assistance or a link to this policy.
- Data Use and Sharing
- Your mobile phone number and opt-in status will be retained as part of your subscription record.
- We will treat your mobile number as personal data and handle it under the terms of our Privacy Policy.
- We will not share, rent, or sell your mobile number to third parties for their independent marketing purposes without your express consent.
- We may share your number (and/or opt-in status) with our service provider(s) managing SMS delivery, under contract and for limited purposes (message delivery, analytics) and subject to appropriate safeguards.
- Compliance
We maintain records of opt-in consent (including date, time, method, mobile number, and IP address where applicable) in order to demonstrate compliance with legal requirements.
- Changes to the Program
We reserve the right to modify or discontinue our SMS program at any time, with or without notice. If we make material changes to these terms (e.g., message frequency or whether messages are promotional rather than purely transactional), we will provide notice to you (via text or other communication) and you may opt out if you do not agree to the revisions.
